Thank you for reading our terms and conditions. All bookings will be confirmed by Shotlisting prior to attending.
New clients will be required to pay pro forma invoicing, upfront in total. This condition will be waived only at our discretion. Once we have established a payment history, the client will have payment terms of 7 days from date of invoice. Establishment of payment history will be at our discretion.
In the case of cancellation of less than 2 full working days, payment is not refundable. This condition will be waived only at our discretion. Where practical rescheduling may be arranged, however this will be determined by our schedule and at our discretion.
Cancellation of more than 2 full working days but less than 5 full working days, will receive a 50% refund.
Cancellation of more than 5 full working days will receive a 90% refund.
Only after you, the client, has paid in full the total amount due as stated on the invoice, will you, the client, have the right to use the images. Payment of the deposit alone, does not grant you, the client, the right to use the images and/or digital content, produced by us. Any breach of this term may result in it being report to the IPTC (International Press Telecommunications Council) as a breach of copyright.
At our discretion the booking may be rescheduled. Rescheduling may result in additional charges.
All products and services will be delivered with in the timeframe as outlined except for new customers who have ordered multiple services with varying delivery times. In this case final delivery of images will require payment in full for all services ordered even if some services have not yet been completed.
Delivery times do not include weekends or public holidays. Working days are considered to be non public holiday days, Monday to Friday.
Images will be delivered by a link. This link will only remain active for 30 days from the date of invoice. It is the customers responsibility to download images prior to deletion. We take no responsibility regarding retaining and archiving images beyong this 30 day period. Request to access these images after the 30 day period has expired may result in a $100 administration if a copy exists, which should not be the expectation.
We accept no obligation to provide an additional service that was not ordered prior to the booking date and time. It is you, the client, who is solely responsible for advising us of services required to be performed during the booking.
If paid car parking is required this cost will be passed on to the customer. Free street parking will be utilised as long as it is within 100 meters from the property being shot. If it is further than 100 meters from the property, the closest parking space will be used regardless of cost. A receipt will be provided and the cost will be added to our invoice. This will be accepted and paid by you the customer.
All fees for service are inclusive of GST.
It is the responsibility of you (the client), as your client representative to advise your clients of confirmed appointment times.
You, as the client, should ensure the site of the shoot is in compliance with NSW Work Health and Safety requirements. Failure to do so may, at our discretion, be treated as a cancellation initiated by you, the client. In this scenario the booking fee will be seen as the cancellation fee and be retained by us.
You understand that we do not provide a cleaning service nor accept any obligation to touch or move personal effects. Any decluttering will be done at our discretion. We accept no obligation to provide cleaning services and you accept we will photograph/video the premises as it presents on the date and time of the booking.
You understand that we will not digitally alter or remove existing fixed features of a property like powerlines, damage to walls and drainage pipes in line with Australian law relating to the advertising and display of promotional images and marketing collateral (any digital or printed material used to communicate or promote a company’s brand message, products, or services). We may digitally enhance lawns and sky. Digital object removal will incur an additional cost.
It is the customers responsibility to sign off on all shots taken during the photoshoot, in regard to the perspective, angle and composition of the photos taken. In the scenario that the customer is not available to sign off on photos perspective, angle and composition it will be at the photographers discretion. If the customer requires different perspectives, angles and composition, it will require a reshoot, another booking fee will be charged and the new photos will be charged for in addition to the photos already taken.
Images will be supplied in low-res and/or watermarked, until full payment itemised on the invoice has been made at which time the high-res images without a watermark will be released.
Cancellation will result in 50% of the total scheduled package price being charged as a late cancellation fee. This amount will be deducted from the booking fee and an invoice issued for the outstanding amount. At our discretion the customer may reschedule the booking. Rescheduling may result in additional charges.
If a property is unattended at the time of our arrival and access is not possible, and instructions have not been received from you, the client, a cancellation fee will be charged at 50% of the total booked value. This amount will be deducted from the booking fee and an invoice issued for the outstanding amount.
A waiting fee of $15 for every 15 minutes or part thereof will be charged if the property is unattended or if we are unable to start the shoot at the agreed booking time, and we are instructed to wait to be given access. In this circumstance where a property is unattended, or cannot be accessed, or where we have been given no instructions relating to an unattended property we will consider this as a late cancellation. At our discretion we may consider an unattended property grounds for cancellation and charge 50% of the total scheduled package price as a late cancellation fee. This amount will be deducted from the booking fee and an invoice issued for the outstanding amount.
Camera angles taken will be at the photographer's and videographer's professional recommendation unless specifically instructed otherwise.
Payment in full will be seen of acceptance by you that the work has been completed at satisfactory quality. Once final media is delivered there will be no refund based on the service not being completed due to unsatisfactory quality.
Refunds will not be provided if the images have been delivered in accordance with these Terms. In cases where a claim is made about the service quality not meeting satisfactory criteria, but the criteria stated conflicts with our terms, no refund will be considered. Thus, if you, as the client, believe that the services were not delivered to satisfactory quality based on reasons that contradict our Terms, a refund will not be considered.
Payment must be made in accordance to the terms set out on the invoice particulars.
Cancelling due to weather conditions will be treated as any other cancellation and charged at 50% of the total scheduled price as a cancellation fee. This amount will be deducted from the deposit, or any payment already made, and an invoice issued for the outstanding amount.
Drones cannot be flown in rain or in windy conditions. If the pilot determines that the shots cannot be taken due to adverse weather conditions, the Aerial fees will not be charged, and the client can request these be taken at a later date. In this case an additional booking fee will apply.
Shotlisting retains the right to use any and all content created by us during the provision of services, for the purposes of promotions and portfolios. The purpose of promotion includes the right to display in all print and online media platforms owned and controlled by Shotlisting and its founders. At your request, as the customer, we will refrain from using the images for the aforementioned purpose for up to 90 days.
You (the paying customer) are granted a single irrevocable, royalty free license to use any and all visual content created by us during the provision of services, upon payment in full, in all media throughout Australia and internationally for any purpose. Only you (the paying customer) can transfer the right to use the media supplied by us.
For audio content supplied by us as part of the End Product that is, or includes, an Audio Item, you are granted a license to use the Audio Item on a non-exclusive, commercial, worldwide and revocable basis, for one Single Use. This Single Use is the use as part of the content created by us during the provision of services, End Product (requiring an application of skill and effort). The End Product consists of a sync of the content created by us, during the provision of services, audio-visual or audio-only work, that incorporates the Audio Item as well as other things, so that it is larger in scope and different in nature than the Audio Item alone.
You agree to inspect all services and/ or products and notify us of any defects within 5 working days of the creation of the services and/ or products, failing which we will have no liability for any defects.
